Zusammenfassung

Weit über werbende Auftritte hinaus ist die Gründung einer Privatklinik eine interessante Möglichkeit, neue Betätigungsfelder zu erschließen. Hierbei sind weitreichende Gestaltungsoptionen hinsichtlich der Rechtsform und des Gründerkreises möglich. So kann etwa die zulässige Einbindung von Investoren neue Chancen bieten. Auch im Hinblick auf die Frage der Liquidation der durchgeführten Behandlungen eröffnen sich neue Wege. Die Abrechnung von zuvor mit der Privatklinik vereinbarten Pauschalhonoraren ist unter Beachtung gewisser Voraussetzungen nach vorliegender Auffassung möglich. Eine Bindung an die Gebührenordnung für Ärzte (GOÄ) in diesem Fall also nicht zwingend. So ermöglichen die Gründung und der Betrieb einer Privatklinik auf verschiedenen Ebenen neue und interessante Handlungsoptionen.

Abstract

The foundation of a private clinic is an interesting possibility to develop new fields of activities far beyond advertising appearances. In this context far-reaching design options are possible with respect to the legal structure and the founder circle. The permissible incorporation of investors can offer new prospects. New possibilities are also opened up even with respect to the question of the billing of the treatment carried out. According to the current opinion, the billing of flat-rate fees previously agreed with the private clinic is possible in compliance with certain prerequisites. Compliance with the medical fee schedule (GOÄ) is not compulsory in this case. In this way the foundation and running of a private clinic enable novel and interesting treatment options at various levels.
